Union Cabinet approves amendment to Insolvency Code stressing on the essence of time for completion of the entire corporate insolvency resolution process
Following the second amendment in the Insolvency and Bankruptcy Code, 2016 being passed by the Union Parliament on 10.08.2018[1] the Union Cabinet on Wednesday cleared a slew of amendments to the Bankruptcy Code with an “aim to fill critical gaps in the corporate insolvency resolution framework as enshrined in the Code, while simultaneously maximizing value from the Corporate Insolvency Resolution Process (CIRP)” as per the press release by the Ministry of corporate affairs dated 17.07.2019.

The Telecom Disputes Settlement and Appellate Tribunal, New Delhi (TDSAT) allowed Veecon Media and Broadcasting Private Limited (Veecon) to use the name “Tiranga TV” for its news channel, without the logo having saffron and green colours used in the national flag.
This decision of the Tribunal quashed the decision taken by the Union Ministry of Information and Broadcasting on March 27 refusing to sanction the name 'Tiranga TV'. The Ministry had held that it amounted to colourable imitation of national flag and violated the Emblem and Names (Prevention of Improper Use) Act 1950 and Flag Code 2002.

The National Company Law Tribunal (NCLT) rejects a plea by a group of homebuyers to treat them as a separate sub-class of creditors at committee of creditors (CoC) meetings for the insolvency resolution of Jaypee Infratech.
The plea sought this classification so that absentee homebuyers’ votes can be factored in as ‘yes’ vote. The judgement stated; “The CoC, taking into consideration Section 21(2) of Insolvency and Bankruptcy Code, 2016, shall comprise all financial creditors, and must be construed as one and cannot be segmented class-wise particularly for the purpose of computation of voting share.”

Supreme Court has observed that cognizance of a complaint filed under Section 138 of the Negotiable Instrument Act can be taken by the Court even after the prescribed period, if the complainant satisfies the Court that he had sufficient cause for not making a complaint within such period.
The Bench comprising of Justices DY Chandrachud and Hemant Gupta made note of this aspect while quashing a Patna High Court verdict. They have observed that a delay in filing a complaint for cheque bouncing can be condoned if the complainant is able to show sufficient reasons to justify the same.

Bombay High Court has imposed a fine of Rs. 10 lakh on a 75-year-old businesswoman for filing a “frivolous litigation” against the Brihanmumbai Municipal Corporation (BMC) in relation to two plots of land owned by the civic body in Powai and “wasting precious time of the court”.
The Bench Comprising of justices SC Dharmadhikari and BP Colabawalla, last week, directed the businesswoman, Renuka Batlivala, to pay the amount to BMC within four weeks, failing which, the civic body will recover it as arrears of land revenue.

Supreme Court has slapped cost of Rs. 25,000 on a litigant for filing incorrect translation of a Rajasthan High Court judgment impugned in Special Leave Petition filed by him.
