The Apex Court Decides That MPS, MLAS Not Barred From Practicing Law
The Hon’ble Supreme Court ruled that members of Parliament and Members of Legislative Assembly cannot be barred from practising law. The Apex court made it clear that Rule 49 of the Bar council of India Rules is applicable only to an individual who is a full-time salaried employee and does not cover legislators under its ambit. “Legislators cannot be styled or characterized as full-time salaried employees as such, much less of the specified entities. For, there is no relationship of employer and employee”, held the judgment authored by Justice A M Khanwilkar.
